These Terms govern your use of www.talecreations.com and purchases from Talecreations. By using the store or placing an order, you agree to the applicable Terms. Our Privacy Policy explains information handling and is not a substitute for consent where consent is legally required.

1. Eligibility and accounts

You must be legally able to enter into a purchase contract, or act with the permission and supervision of a parent or guardian who is responsible for the transaction. Provide accurate information and keep login credentials secure. Tell us promptly about suspected unauthorized account activity.

2. Products and descriptions

We sell backpacks, bags, luggage and related accessories as described on product pages. Screen settings may affect displayed colors. We aim to describe products accurately; nothing here excuses material misdescription or limits applicable remedies. Follow product care and safety instructions. Brand and collaboration references identify the relevant goods and rights holders; they do not by themselves establish that Talecreations is the manufacturer, brand owner or an authorized brand partner.

3. Orders and acceptance

Submitting an order is an offer to buy. An automated receipt acknowledges receipt of the order. We accept an order when we send a shipment confirmation, unless we expressly confirm acceptance earlier. Payment authorization or collection may occur before shipment. We may decline or cancel orders for stock shortages, suspected fraud, legal restrictions or a material listing error. We will notify you and promptly refund any amount collected for an order we decline or cannot fulfill. We will not charge a higher corrected price without your agreement.

4. Prices, taxes and payment

The currency, item prices, applicable discounts, shipping and taxes collected by us are displayed at checkout before payment. You authorize the displayed order total using an eligible payment method you are entitled to use. Promotions follow their disclosed conditions. Changes in future pricing do not automatically change an accepted order. See our Payment Terms.

5. Delivery, cancellations and returns

Our Shipping Policy, Return & Refund Policy and Cancellation Policy explain applicable procedures. Carrier delays do not eliminate mandatory refund or delivery rights. Voluntary cancellation cutoffs do not restrict rights concerning late shipment, defective goods or other mandatory protections.

6. Intellectual property

Store content and design are protected by applicable intellectual property laws. Rights belong to Talecreations or the relevant owners or licensors. You may use the site for ordinary personal shopping and other uses permitted by law. You may not misappropriate content, impersonate a brand owner or use trademarks in a misleading way. These Terms do not transfer third-party intellectual property rights to you.

7. Reviews and submissions

Submit only content you have the right to share. Reviews must reflect actual experiences, and any material incentive or relationship should be disclosed. By submitting a review for publication, you give us a nonexclusive, royalty-free license to display and reproduce it for store reviews and related promotion, subject to privacy rights and applicable law. Private support messages are not automatically treated as public testimonials. We may remove unlawful, abusive, fraudulent or infringing content without suppressing honest negative reviews merely because they are negative.

8. Acceptable use

Do not use the store for fraud, unlawful activity, harassment, infringement, malware distribution, unauthorized access or interference with other customers. We may restrict access reasonably necessary to address misuse, security threats or legal obligations. Account restriction does not remove valid refund rights or obligations concerning existing orders.

9. Shopify and third parties

Shopify provides our commerce platform. Purchases are made from Talecreations. Payment providers, external links, maps and optional tools may have their own terms and privacy notices. Review them when using those services. We remain responsible for obligations applicable to us as the seller.

10. Warranties and liability

We do not guarantee that website access will always be uninterrupted or error-free. To the extent permitted by law, we exclude implied warranties concerning the website itself. Nothing in these Terms excludes warranties or remedies that legally apply to goods, liability for fraud or willful misconduct, liability for death or personal injury where it cannot be excluded, or any other non-excludable liability.

To the extent permitted by law, we are not liable for indirect or consequential commercial losses arising from use of the website that could not reasonably have been foreseen. This does not limit refunds, replacements, direct remedies required by law or other mandatory consumer protections.

11. Applicable law and disputes

California law and applicable U.S. federal law govern these Terms, subject to mandatory protections of the law where you reside. Contact us first so we can try to resolve a concern. Nothing here imposes mandatory arbitration, waives class-action rights or prevents access to courts or regulators where those rights apply.

12. Changes and general terms

We may update these Terms for future use and orders. Material changes will receive notice when required. The version applicable when an order is placed governs that order unless law requires otherwise or you agree to a change. If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision once does not waive future enforcement.
